In child custody and visitation matters, the legal standard is, and has been for a long time, that the court must do whatever is in the best interests of the child. All too often, the custodial parent is uncooperative or poisons the child’s perception of the other parent and as a result it is expressed that visitation is unwanted. What has changed recently is that the New Jersey courts have come to believe that not only the outcome, but also the process, must be tailored toward the child's interests. As a result, if you can’t resolve these issues, the new process is to have the parents attend a parent education workshop. Once you have completed this workshop, a parenting mediator will be made available to help you work out a parenting structure. The new process uses the term "parenting time" rather than the more traditional term "visitation."

In addition to residential custody (also known as physical custody), child custody involves a separate determination of legal custody. Legal custody means having responsibility for the health, education and welfare of the child and the right to participate in decisions toward those ends. Typically, both parents will be granted joint legal custody of the child, even if one parent gets primary residential custody.
